The importance and purpose of criminal law are also included in Article 1 of the Turkish Penal Code No. 5237.
According to this; “The purpose of the criminal law is; To protect individual rights and freedoms, public order and security, the rule of law, public health and the environment, social peace, and to prevent crime.
There is no obligation to be represented by a lawyer in the Turkish legal system. However, it is mandatory in our legislation for a defendant being tried in a high criminal court to be defended by a lawyer. If the suspect or defendant is unable to choose a lawyer, a lawyer will be appointed during the investigation and prosecution phases to be carried out against him/her for crimes that require a prison sentence of more than 5 years.
High criminal courts are responsible for handling cases and matters related to aggravated life imprisonment, life imprisonment, and imprisonment of more than 10 years. In addition, there are catalog crimes that will be heard in the High Criminal Court within the scope of the Turkish Penal Code. Lawyers who follow up on files related to crimes within this scope are called heavy criminal lawyers.

Mandatory defense counsel; defines the lawyer who is appointed in cases where the suspect or the accused requests the appointment of a lawyer who will represent him/her and provide legal assistance to him/her, or in crimes or conditions stipulated by the law, although the suspect or the accused does not request it.
According to Article 150 of the Turkish Penal Code; The suspect or defendant is asked to choose a defense attorney. The suspect or defendant who has no defense counsel; If the child is so disabled or deaf and mute that he cannot defend himself, a lawyer is appointed without his request.
In addition, in investigations and prosecutions for crimes that require a minimum prison sentence of more than five years, a defense attorney will be appointed, even if the person does not request it, according to the Turkish Penal Code. In addition, it is stated that other issues related to compulsory defense in the Turkish Penal Code will be determined by the regulation to be prepared with the opinion of the Union of Turkish Bar Associations.
